In 1958, Ford had turned the Thunderbird from a two-seat sporty car into a four-seat “personal luxury coupe” [PLC]. That move helped create a whole new class of American car. These cars were not sports cars. They were stylish, comfortable, exclusive, and designed to make an impression. Later cars such as the Buick Riviera, Pontiac Grand Prix, and Chevrolet Monte Carlo all followed that idea.
That was the kind of car the “Sceptre” was meant to be. Designed in 1962 and completed in 1963, it was Studebaker’s vision of a “personal luxury coupe” [PLC].

Critics, environmental groups, and many consumers argue that carbon credit pooling undermines the spirit of climate laws:
- Defeats the Goal: It allows wealthy luxury brands to delay their transition to clean energy. Instead of engineering cleaner cars, they just use their high profit margins to buy compliance.
- Optical Illusion: It creates a mathematical illusion on paper. The actual gas-powered Porsche driving down the street is still emitting the exact same amount of CO₂ into the atmosphere, regardless of how much money was sent to XPENG.
- Corporate Loophole: It can feel like a legal loophole where the wealthy can simply buy their way out of rules that are meant to force systemic change.
Why It Is Seen as a Smart Mechanism [The Policymakers’ View]
Economists and the European Union regulators who created the law view this quite differently. They see it as a highly efficient tool called a market-based incentive:
- A Tax on Gas, a Subsidy for EVs: Porsche has to pay a massive financial penalty for every gas car it sells. But instead of that money going into a government treasury, it goes directly to an EV company (XPENG). Porsche’s profits are literally funding the growth of a competitor’s electric vehicle lineup.
- Global Emission Caps: The regulation is designed to control the total global volume of automotive emissions. If the total cap is respected, the environment experiences the same net outcome whether one company lowers its emissions or two companies balance each other out.
- Economic Flexibility: It prevents automakers from going bankrupt or facing sudden, devastating fines that could lead to mass layoffs, giving the industry an economic “safety valve” while it transitions over decades.
Historical Context: The Tesla Precedent
This is not a new or secret trick. Tesla survived its early, financially fragile years largely because of this exact system. Between 2010 and 2024, Tesla made nearly $10 billion by selling regulatory credits to legacy automakers like Stellantis (Fiat Chrysler) and GM.
Without that “loophole” money funded by gas-car makers, Tesla might have gone bankrupt before achieving mass production. In a twist of irony, the system forced gas-car companies to directly finance the modern EV revolution.
